To a limited degree yes but what the blogger misses is that the system used to determine ‘indefinite detention’ is used only to determine if someone is a combatant…not to punish them for past crimes. It’s possible to be not a combatant but guilty of a crime, a combatant but not guilty of a crime, innocent of both or guilty of both.
